4. Step Parent Adoptions

When the legal or biological parent of a child marries or re-marries, the parent’s spouse may adopt his or her child without terminating the rights of the consenting spouse.

A Step-Parent Adoption may be accomplished where the child’s other biological parent, (who is not petitioning for the adoption) either consents to the adoption or where the Court concludes that the other parent has abandoned his/her parental relationship with the child.

Rumbold & Seidelman can assist you in the following ways:

  • Determine the spouse’s ability to petition for a Step Parent Adoption
  • Determine whether the other biological parent’s consent is required or whether that parent has abandoned a parental relationship with the child
  • Prepare and submit all required documentation and papers for the finalization of the adoption
  • Obtain a birth certificate identifying the spouse as Parent of the child
